1. Scope and provider

(1) These General Terms of Use (“Terms”) apply to the use of the mobile application “Stadtbild” (“App”) for iOS and Android.

(2) The provider and contracting party is:

Hassouna Habibi Würzburger Str. 7b, 51103 Köln, Germany (“we” or “provider”). Contact: hassounahabibi92@googlemail.com

(3) These Terms apply exclusively. Deviating terms are hereby rejected.

2. Subject matter

(1) The App is a knowledge and map game. In solo rounds you place items on a map (e.g. countries, capitals, US states or chemical elements); in the live 1v1 duel, two players compete against each other in real time in the same game. Basic use is free of charge.

(2) The App is funded by advertising. Optionally, you can permanently remove the ads with a one-time, non-consumable in-app purchase (see section 5). There is no virtual currency and there are no consumable goods.

(3) The App is distributed via the Apple App Store and Google Play. The terms of the respective app store operator also apply to obtaining and using the App. For iOS, Apple's standard Licensed Application End User License Agreement applies in addition, unless a different license agreement is provided. Apple and Google are not parties to these Terms.

3. User account

(1) The App can first be used anonymously. To permanently save your progress and to use social features (e.g. duels, friends lists), you can link your account via “Sign in with Apple” or “Sign in with Google”. Before first use, you accept these Terms and the Privacy Policy in the App.

(2) You must be at least 16 years old to use the App. If you are younger, use is only permitted with the consent of your parents or legal guardians.

(3) You must keep your login credentials confidential and are responsible for activities carried out via your account. A chosen display name must not infringe the rights of third parties and must not be offensive, discriminatory or otherwise unlawful.

4. Rules of use

(1) You agree not to misuse the App. In particular, the following is prohibited:

(2) In the event of violations, we are entitled to remove content (e.g. display names or leaderboard entries), to restrict features, or to suspend the account temporarily or permanently.

(3) We have zero tolerance for objectionable content and abusive behavior. You can report objectionable content (in particular display names) and players directly in the App using the “Report” function and block them with “Block player”, or report them by email to hassounahabibi92@googlemail.com. We handle every report within 24 hours of receipt: if the reported content violates these Terms, we remove it and exclude the responsible user from the App.

5. Ad funding and ad-free version (in-app purchase)

(1) The App is free to use and is funded by advertising. In the free version you will be shown ads (e.g. between game rounds). Details on data processing for advertising and on your consent and objection options can be found in our Privacy Policy.

(2) You can permanently remove the ads by unlocking the ad-free version once (“Ad-free”). This is a one-time, non-consumable in-app purchase at the price shown in the app store. All games and features remain fully usable free of charge without this purchase; only the ads are removed.

(3) Payment is processed exclusively via the respective app store (Apple App Store or Google Play). The prices shown there apply. The purchase contract for the in-app purchase is concluded when you confirm the purchase in the app store.

(4) The purchase is linked to your app store account. You can unlock it again on your devices via “Restore purchase”.

(5) Refunds are governed by the terms of the respective app store operator; corresponding requests must generally be addressed to Apple or Google.

(6) We are entitled to change the price and design of the ad-free version for the future, provided this does not unreasonably disadvantage you. An ad-free version that has already been unlocked remains unaffected.

6. Right of withdrawal for digital content

(1) If you are a consumer, you generally have a 14-day right of withdrawal for paid digital content.

(2) The right of withdrawal expires for digital content if we have begun performing the contract after you have expressly agreed that we may begin performance before the end of the withdrawal period and you have confirmed your knowledge that you thereby lose your right of withdrawal (Section 356 (5) German Civil Code, BGB). Since the ad-free version is unlocked immediately after purchase, this is regularly the case.

(3) Withdrawal and refunds are processed via the respective app store (Apple or Google).

7. Availability and changes to the App

(1) We strive for the most uninterrupted availability possible but do not owe it. Maintenance work, technical faults or circumstances beyond our control may lead to restrictions.

(2) We are entitled to further develop the App and to adapt, add or discontinue features, provided this is reasonable for you.

8. Liability

(1) We are liable without limitation for intent and gross negligence and for injury to life, body or health.

(2) In the case of simple negligence, we are only liable for the breach of an essential contractual obligation (cardinal obligation) whose fulfillment makes the proper performance of the contract possible in the first place and on whose observance you may regularly rely. In this case, liability is limited to the typical, foreseeable damage.

(3) Otherwise, liability is excluded. Liability under the German Product Liability Act remains unaffected.

9. Term and termination

(1) The user relationship runs for an indefinite period. You can end it at any time by no longer using the App or by deleting your account in the App (Profile → Account → “Delete account”).

(2) We may terminate the user relationship for good cause, in particular in the event of serious or repeated violations of these Terms, and suspend or delete the account.

10. Changes to these Terms of Use

We may amend these Terms if this is necessary for a valid reason (e.g. a change in the law, in features or in third-party services) and does not unreasonably disadvantage you. We will inform you of changes in a suitable manner (e.g. in the App) before they take effect. If you continue to use the App after they take effect, the amended Terms are deemed accepted; we will point out this right and the significance of the deadline to you separately.

11. Final provisions

(1) The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer protection provisions of the country of your habitual residence remain unaffected.

(2) Consumer dispute resolution: We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board (Section 36 VSBG).

(3) Should individual provisions of these Terms be or become invalid, the validity of the remaining provisions remains unaffected.
